Do I need to sign a new tenancy agreement to renew?

Yes — for certainty and legal protection, a new tenancy agreement is strongly recommended. A simple letter of intent to renew is not a binding agreement on its own. A new agreement sets out the updated rent, new dates, and any changed terms clearly, and can be stamped with BIR.

How much notice do I need to give to renew a tenancy in Philippines?

Most Philippines tenancy agreements require the tenant to give 30 days' written notice of intention to renew before the lease expiry. Check your existing agreement for the exact notice period — some specify a different period. If your agreement includes an option to renew clause, the notice period and conditions stated there take precedence.

Can the landlord increase rent upon renewal?

Yes. Unless your existing agreement includes a fixed renewal rent or a cap on rent increases, the landlord may propose a new rental rate for the renewal term. Rent on renewal is subject to negotiation between landlord and tenant. For units covered by the Rent Control Act (RA 9653, monthly rent ≤₱10,000), annual increases are capped at 7%. Do I need to pay stamp duty again on a tenancy renewal?

Yes — Documentary Stamp Tax (DST) applies to each tenancy agreement, including renewals. The rate is the same: PHP 6.00 for the first PHP 2,000 of annual rent, plus PHP 2.00 for every PHP 1,000 or fractional part thereof in excess. Pay to BIR within 5 days after the end of the month of signing the renewal agreement.

What happens if the tenancy expires without renewal?

If neither party terminates and the tenant continues to occupy and pay rent after expiry, a month-to-month arrangement is created by implication. This carries risk — either party can terminate with short notice, and the original fixed-term protections no longer apply. A signed renewal agreement avoids this ambiguity.

Do I need to check condo corporation rules on renewal?

If you are renting out a condominium unit, check your condominium corporation's rules on lease renewals. Some condos require registration of tenants and may have specific renewal procedures. For apartments under the Rent Control Act, ensure compliance with the lease term and deposit limits (max 2 months deposit + 1 month advance).
